Terms & Conditions
This is an agreement between the hirer (You, Your) and Retro Campervans Pty Ltd ACN 168 158 094 (We, Us, Our) to rent the motor vehicle (Van) described in the rental contract (Contract) which includes all accessories, tools, tyres, and equipment and any replacement vehicle. You are responsible for all payments under the Contract. The Contract consists of the Rental Agreement signed by You and these Terms and Conditions of rental (Terms and Conditions).
1 Rental Pick-ups and Drop-offs
1.1 The Van pickup is available at 10am on the first day of the rental period Monday-Friday unless otherwise specified in the Contract.
1.2 Van drop-off must be before 2pm Monday-Friday on the final day of hire unless otherwise specified in the Contract.
1.3 Late returns fees are deducted from the security bond. Early return of the Van does not entitle You to any refund of the unused portion of the rental.
1.4 Pick-ups and Drop-offs outside of these times must be made by prior agreement with Us.
1.5 Additional days may be possible subject to availability and arrangement with Us.
1.6 The drop-off destination is the same as the pick-up destination. Any change results in a fee of up to $1,000.
2 Rental Period
2.1 Day one of the rental period is the day of pick up, regardless of the time, and the day the Van is returned is counted as the final day, also regardless of the time (Rental Period).
2.2 The minimum Rental Period is subject to change and any such change will be notified to You prior to booking confirmation. As a guide, 2 days is the minimum. A Rental Periods of less than one week attracts an additional short term rental fee and You should refer to Our Hire Agreement document.
2.3 We must be notified and agree to any extension of the Rental Period beyond that stated on the rental agreement in advance of the return date and time or the Van will immediately be reported as stolen. Extensions to the agreed Rental Period must be paid for by credit card or cleared bank transfer before the date of extension directly to You.
2.4 Special rates for longer bookings are at Our discretion.
2.5 Where a Rental Period covers more than one seasonal rate, both or all rates will apply.
3 Return of the Vehicle
3.1 You agree:
(a) the Van is received in a clean condition, with a full tank of fuel and a full gas bottle (where applicable; and
(b) to return the Van in the same clean condition, with a full tank of fuel and a full gas bottle (where applicable).
3.2 You will be charged for any fuel or gas which is not refilled. This includes labour and Our administrative costs.
3.3 A $100 cleaning fee applies if the Van is not returned with the interior in a clean condition.
3.4 The toilet and waste water tank (if applicable) must be emptied prior to the return of the Van, or an additional $100 cleaning fee will be retained.
3.5 Late returns attract additional fees calculated at 1/3 of the daily rate per hour late.
4 Road and Area Restrictions
4.1 The Van must only be driven on:
(a) a sealed/bitumen road; or
(b) a well-maintained access roads which are less than 500m long to access official camping areas.
4.2 Subject to clause 4.1(b) the Van must never be driven:
(a) on any unsealed or unformed road;
(b) through water, rivers, streams of flood water;
(c) on any beach or through sand or mud; or
(d) in any area that is off-road.
4.3 Travel on unsealed roads or use of the Van in any area listed in clause 4.2 is a breach of these terms and conditions and voids all liability limitations and damage cover. You are liable for the total cost of any damage to the Van and for any third party whilst travelling in any such area.
4.4 If We have reason to believe that the Van may have been driven on an unsealed roads the Van Security Bond will be retained until a complete inspection of the Van determines if any damage has occurred. You are liable for any damage found.
4.5 You must only use the Van between Coffs Harbour and Noosa unless You have Our prior written approval and travel outside these areas without that prior approval is a breach of the Contract.
4.6 We reserve the right at Our sole discretion to restrict Van movements to certain areas due to adverse road or weather conditions.
4.7 Your hire period includes 125 km per day of travel. Additional included km may be purchased at time of booking or at Pick Up. A charge of $0.35 per km applies for travel over and above the included km
5 Prohibited Use
5.1 The Van must not be driven by:
(a) a person who is not identified on the rental agreement or has not been identified in writing to the Company or approved by the Company in writing;
(b) a person who is not licensed for that class of vehicle;
(c) a person who is intoxicated or whose blood alcohol concentration exceeds the legal limit or is under the influence of drugs; or
(d) a person who has given or for whom You have given a false name, age, address or driver’s licence.
5.2 It is Your responsibility to inform Us if You have limitations on Your licence to drive such as for automatic vehicles only
5.3 The Van must not be used:
(a) outside the limited area of use referred to in clause 4.5;
(b) on unsealed or unformed roads or on any other area referred to in clause 4.2;
(c) to carry persons for hire or reward;
(d) to carry any inflammable, explosive or corrosive materials unless authorised in writing by Us or in addition to any already supplied in the Van;
(e) to propel or tow any vehicle, trailer, boat or other object unless We have authorised such use in writing;
(f) to carry any greater load and/or persons than is lawful or use in a manner or for a purpose other than for which it was designed;
(g) to carry any animal or pet, other than assistance animals, unless authorised in writing by Us;
(h) in any motor sport event, including time trials, hill climbing, reliability trials, speed trials, racing or in preparation for those purposes;
(i) in an unsafe or unroadworthy condition;
(j) in a dangerous or reckless manner; or
(k) for any illegal purpose.
5.4 You must not:
(a) modify the Van in any way;
(b) sell, rent, lease or dispose of the Van;
(c) register or claim to be entitled to register any interest in the Van under the Personal Property Securities Act 2009 (Com); or
(d) damage the Van deliberately or recklessly or allow anyone else to do so.
6 Financial Obligations
6.1 Joint hirers and all drivers are jointly and severally liable under the Contract.
6.2 At the start of the Rental Period We will debit Your credit card with a bond (Security Bond) as security for the rental changes and other fees and charges incurred during your rental, including the Damage Liability Fee).
6.3 You must pay on demand, and by entering into this Contract You authorise Us to debit Your credit card and/or the Security Bond amount with, the following charges:
(a) all rental charges specified in the rental agreement;
(b) the Damage Liability Fee;
(c) all fines for speeding, parking or traffic infringements and tolls in accordance with clause 11.
(d) all damage to the Van (including loss of use), damage to third party property, legal expenses, assessment fees, towing and recovery, storage and company service charges where:
(i) any term or condition of this Contract has been breached;
(ii) the Van is involved in a single vehicle accident;
(iii) You have left the Van unlocked or the keys in the Van;
(iv) You have not kept the keys securely and under Your personal control;
(v) the underbody of the Van is damaged regardless of cause when no other vehicle is involved;
(vi) the Van is totally or partially immersed in water regardless of cause;
(vii) the interior of the Van is damaged regardless of cause when no other vehicle is involved;
(viii) the tyres of the Van are damaged other than by normal wear for the kilometres travelled;
(ix) the Van is damaged by driving it under or into an object lower than the height of the top of the windscreen of the Van;
(x) You have failed to maintain all fluid and fuel levels or failed to immediately rectify or notify Us of any defect of which You become aware;
(xi) the Van is damaged by either loading or unloading, other than normal wear; and
(xii) Your failure to secure properly any load or equipment which leads to loss caused by any part of said load or equipment.
6.4 If You have paid by use of a credit card or directed Us to bill charges to some other person, corporation, firm or organisation who or which fails to make payment when due, You will immediately pay the full amount due to Us on demand.
7 Damage Cover
7.1 All Our Vans come with damage cover and provided that no terms or conditions of the Contract have been breached You have cover for:
(a) the cost of damage to the Van or its replacement as a total loss as a result of accident, fire or break-in;
(b) towing and recovery costs;
(c) loss of the Van through theft; and
(d) damage to the property of any third party
but You must pay for the first AUD$3,300 (including GST) ($3850 if youngest driver age is 21-24 years) (Damage Liability Fee) of any loss, damage or cost, unless you have opted for and paid in advance for reduced Damage Liability Fee in which case you must pay the first amount equivalent to the Damage Liability Fee selected.
7.2 There is no damage cover for single vehicle accidents, windscreen and tyre damage, overhead and underbody damage.
7.3 If the Security Bond is paid by credit card the amount will be debited to Your credit card immediately, and any currency fluctuations are not Our responsibility. The Security Bond is fully refundable on return of the Van to the agreed location, on the agreed date with no damage incurred to the Van or third party property and no items are lost, damaged, or soiled and subject to there being no other breaches of the terms and conditions of the Contract.
7.4 Windscreen chips are charged at $60 each and any more than 3 chips will result in a windscreen replacement charge of $300.
7.5 There is no cover for personal items damaged in or stolen from the Van. We recommend You do not leave Your valuables in the Van because of possible theft. We strongly recommend that You take out Your own premium travel insurance.
8 Credit Card Payments
8.1 If a credit card is presented as payment by a person who is not the hirer, the credit card holder and You are jointly and severally liable for all rental changes and payments due under this Contract.
8.2 Visa and MasterCard are accepted and a credit card fee of 3% applies to use of either card for payment and Security Bond purposes. The credit card administration fee will not be refunded.
8.3 If You cancel the booking, You agree that:
(a) We are irrevocably authorised to complete any documentation and take any other action to recover from Your credit card issuer all amounts due by You pursuant to the Contract, including, but not limited to, any amounts due in respect of damage to the Van or to property of a third party and all other additional charges as they are incurred including all parking and traffic infringement penalties, road toll fines and associated administration costs;
(b) You will not dispute Your liability to Us for any amount properly due under the Contract and You shall indemnify Us and keep Us indemnified against any loss incurred (including legal costs) by reason of notifying Your credit card issuer of such dispute;
(c) In the event that We elect to accept payment of the Van security bond by holding a signed and authorised open credit card voucher which is returned to You at the completion of the rental period, You agree that We are entitled to recover payment from the Your credit card issuer pursuant to paragraph (a) in respect of any amounts due which were not known at the time of return of the voucher; and
(d) We may process credit card charges pertaining to the rental after the hire period.
8.4 You acknowledge that all transactions under this Contract are conducted in Australian currency. Due to exchange rate fluctuations and bank fees, there may be a variance between the amount initially debited against Your credit card and the amount refunded. We accept no liability for any such variation.
9 Security Bond Payment
9.1 If a credit/debit or EFTPOS card is submitted for payment of the Security Bond the funds may be debited immediately (this depends on Your bank).
9.2 The Security Bond will be refunded within 30 days of the Van being returned provided that:
(a) all amounts due under the Contract have been paid;
(b) the Van was returned on-time and undamaged;
(c) there is no third party damage;
(d) the Van’s exterior and interior are clean;
(e) the Van is returned with a full tank of fuel and a full gas bottle (where applicable); and
(f) the Contract has not been breached.
9.3 If there is damage to the Van on its return, the Security Bond will be used to cover the cost of such damage up to the amount of the Damage Liability Fee. However, if the terms of the rental contract are breached and the Security Bond is insufficient to cover the damage You are liable for any shortfall and the extra cost will be charged to Your credit card.
9.4 A Security Bond is payable for each accident/damage and not per rental, so that if You report an accident to Us, another Security Bond will need to be pre authorised, otherwise You cannot continue with the rental.
9.5 Accidents and any other damages must be reported to Us within 24 hours of the occurrence or all liability limitations and cover products are void.
10 Change of Vehicle
10.1 If, for reasons beyond Our control, the reserved Van is not available, We reserve the right to substitute a similar class or type of Van at no extra cost to You. The Van may be a different make, model and age to the originally hired Van. This shall not constitute a breach of contract and does not entitle You to any form of refund.
11 Infringements, fines & tolls
11.1 You are liable for all fines for speeding, parking or traffic infringements and tolls.
11.2 The processing of any claim by a regulatory authority for any fines for speeding, parking or traffic infringements or tolls incurred during the Rental Period will result in an administration fee of $75 being charged to Your credit card or deducted from Your security deposit, together with any unpaid fine or toll.
12 Minimum Age
12.1 You and the driver must be over 21 years of age with two years minimum driving experience.
12.2 A medical certificate verifying Your state of good health is required if You are over the age of 75.
13 Smoking, Animals, Pets, Candles & Mosquito Coils
13.1 Smoking, the carriage of pets or other animals, other than assistance animals, and/or use of candles or mosquito coils are expressly prohibited.
13.2 In the event of a breach of these conditions the Security Bond will be retained and used against the cost of having the Van professionally cleaned and fumigated.
14 Deposits and Cancellations
14.1 Full payment is required when booking direct.
14.2 When a holding deposit has been paid to an agent the remaining amount will need to be paid directly to Us within 24 hours of the booking. Failure to do so will result in the loss of the booking and the deposit. Where possible We encourage full payment to be taken by the agent including insurance.
14.3 The following fees must be paid for cancellation after:
(a) reservation: – $250 administration fee;
(b) 14-21 days prior – $500 booking administration fee;
(c) 3-13 days prior- 50% of the full rental fee;
(d) 0-2 days prior and a ‘no show” – up to 2 days after commencement of hire due payment of the full rental fee.
14.4 On a no show, the Van may be rehired after 2 days
14.5 There are no refunds for early return or late pick up of the Van, excepting in the case of mechanical breakdown where remaining full days rental will be refunded if repairs have not been possible or a substitute van has not been supplied. We will also refund the daily hire charge for any days should you lose total use of Van.
15.1 Any problems associated with the Van, including equipment failure, must be reported to Us as soon as possible and within 24 hours in order to give Us the opportunity to rectify the problem if possible during the rental. We do not accept liability for any claims submitted after this period.
15.2 Repairs up to AUD$100 may be effected without authorisation and will be reimbursed. For amounts over AUD$100, We will need to be informed in advance and no refunds will occur without approval from one of Our staff members.
15.3 Repairs will be approved for refund provided You were not directly responsible for the damage.
15.4 Receipts must be submitted for any repair or the claim will not be paid.
15.5 Punctures/tyre repairs or replacement from damage are Your responsibility.
16 Fuel, Oil and Water Levels
16.1 You must use the correct fuel type for the Van;
16.2 At least daily, You must check and maintain all fluid levels and must immediately rectify and report to Us any defect of which You become aware of.
16.3 Continued operation of the Van after a defect has occurred may lead to serious consequential damage to the engine for which You are responsible.
17.1 If the temperature gauge moves in a direction that is above normal, stop immediately, investigate and call Us. Do not wait for it to cool and drive again as You may cause further catastrophic damage to the engine, for which You are liable.
17.2 Driving with an inoperative temperature gauge voids all liability limitations and damage cover and will result in You being held liable for any damage to the Van if overheating occurs.
18 Retro Campervans Water Crossings and Wet Weather Driving
18.1 If for any reason You cross or drive through water of any kind, You are in breach of the terms and conditions of this Contract. If this results in damage to the Van in any way, You have no damage cover and You are fully responsible for the repair to or replacement costs of the Van.
18.2 You also give permission for these costs to be debited You credit card used on the rental to pre authorise the liability level You have selected. If no damage is detected immediately, we reserve the right to have the Van inspected at completion of the rental
19 Roadside Assistance
19.1 For Your peace of mind, all Vans are covered by free NRMA breakdown assistance. This will enable an attempt to fix the breakdown, or if necessary provide a free tow to the nearest approved repairer. This option should only be used after contacting Us in the first instance or You may be liable for any unnecessary fees.
19.2 Failure to inform Us prior to a tow request may result in a $500 fee.
19.3 NRMA can also be used for help in situations caused by You such as locking keys in car, running out of fuel or flat battery for a moderate charge payable directly to NRMA.
20 Equipment Supplied in the Van
20.1 Equipment supplied by Us includes plates, bowls, mugs, cutlery, can opener, cooking utensils, coffee plunger, chopping board, kettle, frying pan, saucepans, dishcloth/brush, dustpan and brush, pillows and pillowcases, base and top sheets and duvets or sleeping bags if requested, tea towels, gas fire lighter, fire extinguisher and a full LPG gas bottle.
20.2 Additional equipment may be hired at the time of pick up or before depending on availability. These items may include:
(a) Bedding Pack;
(b) Kitchen/Dining Set;
(c) Beach Towels;
(d) Table and chairs;
(g) Beach shades or umbrellas;
(h) Wind breaks;
(i) First Aid Kits.
20.3 Fees apply for any items broken or lost items.
